THIS AGREEMENT, made this  _____day of _Jan 14, 2019 between the NATIONAL IRRIGATION ADMINISTRATION, with principal office address at NIA Bldg., EDSA, Quezon City, represented by its Administrator, GEN RICARDO R VISAYA (Ret) (hereinafter called the “Entity”) and TOKWING CONSTRUCTION CORPORATION / ASC CONSTRUCTION AND CONCRETE PRODUCTS (Joint Venture), with principal office address at 49 Tamaray Street, Atulyan Sur, Tuguerarao City, Cagayan, represented by its Authorized Managing Officer,    ABRAHAM S. COLLADO     (hereinafter called the “Contractor”).

WHEREAS, the Entity is desirous that the Contractor execute the Construction of Pump Appurtenant Structures, including Supply, Delivery, Installation, Testing and Commissioning of Pump, Electric Motors, Valves, Discharge/Steel Pipes and other Electro-Mechanical Works under the Alfonso Lista Pump Irrigation Project, Invitation to Bid No. CAR-ALPIPD-C-2, (hereinafter called “the Works”) and the Entity has accepted the Bid for Four Hundred Fifty Five Million Eight Hundred Forty Nine Thousand Seven Hundred Forty Seven and 94/100 Pesos (PhP455,849,747.94) by the Contractor, for the execution and completion of such Works and the remedying of any defects therein.

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. In this Agreement, words and expressions shall have the same meanings as are respectively assigned to them in the Conditions of Contract hereinafter referred to.
2. The following documents shall be attached, deemed to form, and be read and construed as part of this Agreement, to wit:
   1. General and Special Conditions of Contract;
   2. Drawings / Plans;
   3. Technical Specifications;
   4. Invitation To Bid;
   5. Instructions to Bidders;
   6. Bid Data Sheet;
   7. Supplemental/Bid Bulletin No. 1;
   8. Bidder’s Financial Component of Bid containing the Bid form including Detailed Breakdown of Estimates;
   9. Bidder’s Technical Component of Bid containing its Eligibility and Technical Documents;
   10. Performance Security;
   11. Credit Line Certificate;
   12. Notice of Award of Contract and the Bidder’s conformity…
